Under CSRS and FERS rules, reemployed annuitants typically have their salaries reduced by their annuity amount. However, the CDC may waive this salary offset under the National Defense Authorization Act (NDAA), allowing certain annuitants to work without salary reduction in specific cases.
The 2010 NDAA authorizes agencies to temporarily employ retired annuitants without offset to support critical agency functions, training, mentoring, and employee retention. This applies to temporary appointments of up to 1 year, which may be extended in increments up to 1 year.
If an annuitant retired within 6 months before hire, the initial appointment is limited to 6 months and 520 work hours. This may be extended by another 6 months with the same hour limit, totaling 1,040 hours per year. Further extensions may be granted in one-year increments. In cases where hospital or mentoring duties are the primary responsibilities, up to 520 hours may be excluded from hour limits.
Annuitants under this waiver may exceed hour limits, but salary for excess hours will be offset. Work under the waiver does not affect annuity benefits, no retirement contributions are deducted, and this employment does not count toward further retirement entitlement.
This waiver authority expires December 31, 2024.
