The President has amended Executive Order 13603 to update the delegation of authorities under the Defense Production Act for energy matters. The amendment grants both the Secretary of the Interior and the Secretary of Energy independent authority over energy issues within their respective domains.
If disputes arise between the two Secretaries regarding any type of energy, the matter will first be referred to the National Energy Dominance Council. For disputes involving national defense infrastructure or military operations, the issue must be referred to both the National Energy Dominance Council and the National Security Council, with the Department of War participating in the resolution process.
Further amendments specify that for energy production, construction, distribution, and related activities, both Secretaries can exercise delegated authority independently. Additionally, certain presidential authorities under the Defense Production Act are now delegated independently to the Secretaries of the Interior, Commerce, and Energy.
The order clarifies that it does not impair any existing legal authority granted to executive departments, agencies, or their heads.
